Definitions and Application:
o The “Company” refers to Clearstile.
o “Person” includes individuals or any corporate entities.
o “Owner” pertains to the owner of the goods involved in any business transaction.
o “Customer” denotes anyone purchasing goods from Clearstile.
o “Goods” encompass tiles, wood flooring, bathroom materials, and related items.
o All orders and business activities are subject to these conditions, which cannot be altered by any employee or agent of the Company.
Responsibilities Specifically Accepted By The Customer:
o The Customer bears ultimate responsibility for ordering the correct quantities, sizes, or dimensions of goods.
o The Company does not accept responsibility for incorrect measurements or consequences arising from purchasing incorrect quantities or types of goods.
o Risk passes to the Customer upon collection or delivery, and appropriate insurance cover and security are the Customer’s responsibility.
o Goods must be collected within 2 weeks of delivery to the Company’s warehouse; otherwise, storage charges apply.
o All goods collected or delivered must be examined and signed for by the Customer, and no claims for damaged materials or shortages will be entertained afterward.
o Shading variations in tiles and flooring are inherent; Customers should order the correct quantity based on their requirements.
Ownership and Risk:
o Goods remain the property of the Company until full payment is received.
o Risk passes to the Customer upon collection or delivery.
Acceptance of Terms:
o Acceptance of goods by the Customer constitutes conclusive evidence that these terms apply.
o Previous dealings do not replace or vary these terms.
Special Orders:
o Special orders are orders for non-stock goods. Once a special goods order has been placed no cancellation of your order shall be permitted and no refund shall be made by us in respect of such goods. This does not apply to faulty or incorrectly supplied goods where your statutory rights are unaffected.
Material Characteristics:
o As colour, glaze and application can vary considerably over a period of time, samples delivered or on display are for general guidance only and not necessarily identical to current stock.
o In particular, natural stone material incorporates characteristics such as fossilization, fissures, porosity, irregular edging, indentations and small chips and may vary considerably from batch to batch.
o Crazing is also an inherent quality in glazed tiles. It is not a fault and often enhances the tile. No guarantee can be given by the Company against crazing.
o All tile sizes are nominal but within acceptance tolerances of the tile industry.
o The number of tiles indicated per square metre or square yard is nominal and may take into account appropriate jointing.
o Product manufacturers reserve the right to change materials, components, design or dimensions of any goods without prior notification.
o It is the responsibility of the Customer and his or her agents to ensure that care and maintenance of bathroom and flooring products is carried out in accordance with the manufacturer’s prescribed guidelines. It’s also important that regular maintenance procedures are consistent with any relevant risk assessments which reflect the specific on-site conditions.
o Please note that tile samples are indicative only. Shade variation is a characteristic of tile products and colour and tone can vary from piece to piece. There may be a variation between a sample and the subsequent tile order due to different tile production batches.
Orders And Pricing:
o Orders are accepted and estimated availability dates given on the understanding that the Company has available unsold stock or will be able to secure the required goods from its suppliers on time. Whilst the Company will use its best endeavours to meet such dates, it can accept no responsibility for any losses that might be suffered by the Customer as a consequence of any delays.
o As the number of tiles or flooring indicated per square metre is nominal and can take into account appropriate jointing, the prices displayed and quoted per square metre are to be taken as indicative only. Orders processed for goods are invoiced at “each”.
o Digital images, catalogues, price lists and other advertising material are only indications of the type of goods offered and are subject to variation from time to time by the Company and shall not constitute an offer or be binding on the Company.
o We will contact you if an incorrect price was displayed for any items in your order, offering you the option of proceeding with your purchase of the items at the correct price or cancelling the order.
Cancellation & Returns:
o We are unable to accept part order refunds and we do not accept returns of excess tiles.
o Cancellation of bespoke, customised or special order (unstocked) goods are non-refundable. In addition to this, goods sold as part of a sale, promotion, clearance or as ex-display will not be accepted for return or exchange. This does not apply to faulty or incorrectly supplied goods where your statutory rights are unaffected.
o If you wish to return your complete order following delivery you may do so by informing us within 14 days of receipt of delivery by emailing info@clearstile.ie.
o We ask that you take reasonable care when handling the goods and return the goods unopened, unused and within 30 days of the initial delivery.
o Where possible the goods should be returned in their original packaging.
o Returning goods to us is at your own cost and risk.
o We are not responsible for any loss or damage to any goods returned in transit and as such we recommend that you return the goods through a recorded delivery service.
o If the goods returned are not fit for resale as a result of the goods or packaging having been damaged, the monies will not be refunded and you will be required to collect the goods from our warehouse within 7 days of having been notified of this fact. If the goods have not been collected within the 7 day timeframe, the goods will be disposed of.
o If returned goods are received damaged in part or in full, we reserve the right to deduct the value of the damaged goods from your final refund.
o We reserve the right to ask for photographs as evidence of damage.
o Goods accepted for return at our discretion outside the 30 days in perfect condition will incur a 25% re-stocking charge.
